Understanding Legal & Dispute Appraisals

A legal or dispute-related real estate appraisal is an independent, written opinion of value prepared by a certified appraiser for a defined effective date and a specific intended use connected to a legal matter or property dispute. It is developed according to the Uniform Standards of Professional Appraisal Practice (USPAP) and is intended to provide objective, market-supported valuation evidence for attorneys, accountants, courts, trustees, and the parties involved.

Legal disputes involving commercial real estate frequently turn on the value of the property itself. An independent appraisal gives the parties and their advisers a credible, defensible basis for discussion, negotiation, or presentation — rather than an unsupported estimate. The appraisal, however, does not itself resolve the dispute, allocate debts, establish legal rights, or determine how assets must be divided. Those decisions belong to the parties, their attorneys, and the court.

Independent Role: Greencrest Appraisal provides independent real estate valuation services. We are not a law firm, we do not provide legal or tax advice, and we do not represent property owners as legal counsel. The appraiser's role is to develop an unbiased opinion of value; the attorney's role is to handle the legal matter, and the tax adviser's role is to handle tax questions.

What Every Legal Assignment Has in Common

Although divorce, bankruptcy, foreclosure, IRS matters, and partnership dissolution each raise distinct questions, every legal or dispute-related appraisal shares four core requirements that must be defined before engagement:

Independent Analysis

The value opinion is developed from market evidence, not tailored to support a client's preferred position or outcome. The conclusion may be above or below a party's expectations.

Defined Effective Date

The valuation date is tied to the matter — current or a specific historical date — and is confirmed with the client and their advisers, not assumed by the appraiser.

Clear Intended Use

The report states the specific purpose it supports. A report prepared for one purpose is not automatically suitable for another without review.

Named Intended Users

The report identifies who may rely on it. Sharing a copy is different from making another party an intended user.

Assignment Types

How Valuation Supports Different Legal Matters

Each legal situation raises a distinct valuation question. The explanations below describe how an independent real estate appraisal may inform each matter — and the limits of what an appraisal can decide.

Divorce & Property Division

An independent appraisal can provide a market-supported opinion of value to inform settlement discussions, a proposed buyout, or the division of real property. The appraised value is distinct from equity, debt allocation, ownership rights, and the final settlement — legal matters determined by the parties and their attorneys. The appropriate valuation date depends on the jurisdiction and the matter and is confirmed with the client's attorney. Appraised value does not automatically determine either spouse's payout, and one spouse does not automatically have the right to authorize access to every property or obtain all confidential assignment information.

Bankruptcy-Related Real Estate Valuation

Bankruptcy proceedings can involve questions about the value of real estate assets, but the specific requirements vary by bankruptcy chapter, court, trustee, and property. An independent appraisal can provide value information relevant to those questions. Greencrest Appraisal does not recommend a bankruptcy strategy, and an appraisal does not protect assets, eliminate debt, determine exemptions, or establish an accepted court value on its own. Assignment-specific legal requirements should be confirmed with the client's attorney before engagement.

Foreclosure-Related Appraisal Needs

Where a foreclosure-related valuation is requested, the service offered is an independent valuation of the property — for a dispute, a pre-foreclosure situation, or a lender-owned property — not legal representation. An appraisal does not stop a foreclosure, change a debt balance, or establish a borrower's legal rights. Foreclosure status does not automatically imply one universal discount, and liquidation value is not automatically substituted for market value. The applicable definition of value is confirmed for the specific assignment, and lender acceptance or a particular outcome is never guaranteed.

IRS & Tax-Related Appraisal Matters

Real estate valuation may be relevant to certain tax matters, such as estate-related valuations, gifts, or charitable contributions involving real property. The documentation, timing, appraiser qualification, and reporting requirements can differ for each tax purpose and are not identical across assignments. Greencrest Appraisal does not claim that every report is a “qualified appraisal” for a specific tax purpose unless the requirements for that purpose are confirmed. An appraisal does not by itself establish tax liability or guarantee IRS acceptance. Clients should confirm the applicable requirements with their tax adviser or attorney before engagement.

Partnership Dissolution & Property Buyouts

Valuation of partnership-owned real estate can inform negotiations, a property sale, or a proposed buyout. The value of the underlying real estate, however, is distinct from the value of the business or an individual partnership interest. A partner's interest is not automatically equal to their ownership percentage multiplied by the property's appraised value, and ownership-interest discounts, partnership-agreement interpretation, and buyout obligations are outside the scope of a real estate appraisal. Business or ownership-interest valuation is a separate service that must be independently verified.

Effective Dates & Scope

Valuation Dates, Property Rights, and Assignment Scope

The client, intended users, intended use, effective date, relevant property rights, and scope should all be clarified before engagement. The effective date of value is distinct from the inspection date and the report date — a present-day inspection documents the property as it exists today and does not, by itself, establish its historical condition.

Key Assignment Parameters Defined Before Engagement:

  • Effective Date: The date to which the value opinion applies — current or a specific historical date such as a date of death, date of separation, or another legally relevant date. The date is not automatically the date of separation, filing, foreclosure, or transfer; it is confirmed with the client and their advisers based on the purpose of the assignment.
  • Value Definition & Property Rights: The applicable definition of value and the property rights appraised are confirmed during engagement. Not every assignment uses the same definition of value, property interest, inspection scope, or report format.
  • Intended Use & Intended Users: The report states its intended use and the intended users who may rely on it. Report access and permitted use depend on the engagement and applicable obligations. Paying for an appraisal does not allow the client to control its conclusion, and changing the client name does not make an existing report suitable for a new purpose.

Retrospective Assignments: When the effective date is historical, the appraiser researches historical market data and property characteristics relevant to that date. If access is restricted or historical property information is incomplete, the appraiser discusses available documentation and how it affects the scope before proceeding.

Preparation

Documents and Information to Prepare

Organizing a few details in advance helps the appraisal proceed smoothly. You do not need everything before reaching out — we will confirm the specific records needed for your property type and assignment:

Property & Purpose

  • • Property address, type, and approximate size
  • • General purpose of the appraisal
  • • Required deadline or valuation date from adviser
  • • Ownership interest or property rights to appraise

Records & Access

  • • Surveys, floor plans, and prior appraisals
  • • Records of improvements or condition issues
  • • Historical photos or records (retrospective assignments)
  • • Leases, rent rolls, and expenses (if income-producing)

Property Access: A party to a dispute does not automatically have the right to enter the property. Access for an inspection is coordinated with the party who can authorize it, and scope and access requirements are established before engagement. Case-specific instructions or document excerpts are arranged through an appropriate communication channel.

Data Privacy Notice: Please do not upload tax returns, court filings, account numbers, Social Security numbers, or confidential dispute details through the general contact form. Once an engagement is discussed, we establish secure, direct file exchange with our appraisal team.

Report Use & Testimony

Report Use and Expert Testimony

Preparing a written appraisal report is distinct from providing consultation, deposition support, or courtroom testimony. If testimony or hearing attendance is needed, the scope, availability, and fees must be confirmed separately in a written engagement. Greencrest Appraisal does not claim court appointments, expert witness qualifications, or a testimony history that has not been verified.

Acceptance Is Not Guaranteed

A court, agency, lender, trustee, or other recipient decides what weight to give a report and whether it satisfies their requirements. Greencrest Appraisal does not use unsupported claims such as “court-approved,” “IRS-approved,” or “guaranteed admissible.”

Confidentiality & Privilege

Report access and permitted use depend on the engagement and applicable professional and legal obligations. Attorney-client privilege does not automatically apply to appraisal communications, and absolute confidentiality is not promised. Sharing a report is different from making another party an intended user.

Practical Evaluation

Factors Affecting Cost and Turnaround

Commercial appraisal fees are quoted on a flat-fee basis before engagement, determined by the property's complexity, tenancy structure, the required valuation date, and the reporting format. Comprehensive commercial appraisal reports typically require several weeks depending on property complexity, data availability, and current scheduling. When a legal deadline is involved, reach out as early as possible so the scope and timeline can be confirmed.

No Contingency Fees: Under the Uniform Standards of Professional Appraisal Practice (USPAP) and appraiser licensing rules, appraisers are prohibited from accepting contingent fees based on the outcome of a legal matter. An independent appraisal cannot be tailored to reach a predetermined value or legal outcome.

Adam J. Hardej Jr., MAI, ASA, MBA, is the Chief Appraiser of Greencrest Appraisal.
